Rodzina i jej ochrona z perspektywy praw podstawowych UE

Kurs prowadzony w języku polskim przez dr Annę Juryk. 

Tematyka kursu „Rodzina i jej ochrona z perspektywy praw podstawowych UE” obejmuje podstawowe prawa dotyczące ochrony współczesnej rodziny, a szczególnie dziecka z perspektywy najważniejszych w tej mierze aktów prawnych:

• Karty Praw Podstawowych UE
• Konwencji o prawach dziecka
• Europejskiej konwencji o ochronie praw człowieka i podstawowych wolności.

 

Bardzo ważną rolę w tym zakresie ogrywa także orzecznictwo unijnych organów sądowych oraz ETPCz dotyczące wykładni przepisów wymienionych wyżej aktów prawnych.

W trakcie kursu omówione zostaną m.in.:

• prawo do poszanowanie życia prywatnego i rodzinnego,
• brak dyskryminacji członków rodziny,
• prawo do zawarcia małżeństwa i prawo do założenia rodziny,
• odpowiedzialność rodzicielska,
• alimenty dla dzieci,
• adopcja,
• uprowadzenie dziecka,
• prawo do nauki,
• ochrona życia rodzinnego i zawodowego,
• ochrona zdrowia członków rodziny.

 

Kurs w wymiarze 15 godzin (2 ECTS) łączy w sobie wykład z metodami pracy zespołowej i indywidulanej na bazie kazusów.

“The family and its protection from the perspective of EU fundamental rights”

The subject of the course “Family and its protection from the perspective of EU fundamental rights” covers the basic rights concerning the protection of the modern family, and especially the child, from the perspective of the most important legal acts: the EU Charter of Fundamental Rights, the Convention on the Rights of the Child and the European Convention for the Protection of Human Rights and fundamental freedoms. A very important role in this respect is also played by the jurisprudence of EU judicial authorities and the ECHR on the interpretation of the provisions of the above-mentioned legal acts. During the course, among others, the right to respect for private and family life, non-discrimination of family members, the right to marry and the right to found a family, parental responsibility, child support, adoption, child abduction, right to education, protection of family and professional life, protection of the health of family members.

The 15-hour course combines a lecture with teamwork and individual work methods based on case studies.
